hey everyone, not sure where to post this, please direct me in the right direction if i'm wrong :)

 

I have a question about Trademark license, let me explain, for instant if i create a "clipart" image for an customer which she will have printed onto a shirt, and she wants to trademark the shirt with my design, do i need to set up a trademark license with her allowing her the exclusive rights to this image? And if so, any idea on what i could charge for the license per image? Or shall i charge a one-time fee for all images?

 

Any help would be appreciated :)

If the clipart is in the public domain, all bets are off.

You have no right to it, end of story.

 

If you created the art from scratch, you may wish to

Talk to a lawyer.

You may sign over all rights (as you do at DC), get royalties, limited usage, etc.

This area of the law can get complex and very expensive if you do it wrong.

Trademark, Registered Trademark, copyright and contract laws apply.

 

If you are going to do this as a business, you need to wrap your head around this stuff.

The moderators at this and other crowd source sites spend thousands of man hours on this issue.
